DUIs and Alcohol Crimes

A Driving Under the Influence (DUI) or Driving with a Measurable Controlled Substance (DMCS) charge is one of the more common outcomes of an encounter with police on Utah roads. In 2018, the state legislature lowered Utah’s blood alcohol content limit from .08 to .05, making it the strictest DUI law in the country. The consequences of a DUI or DMCS charge have also become more severe over time, even if you are a first-time offender with a clean record.

If you have been charged with DUI, DMCS, or another alcohol-related driving offense, taking your chances in court on your own or with inexperienced legal counsel is a major risk. Under DUI laws that are considered some of the strictest in the nation, the penalties you face could be crippling. At Pitcher Law, we have substantial experience with DUI and DMCS charges and are prepared to fight aggressively on your behalf.

Drug Charges

Although there have been some changes to Utah’s medical marijuana laws in recent years, most controlled substances remain illegal. For any drug possession or distribution charge, it is important to obtain reliable, experienced legal counsel. With more than a decade of experience, Stephanie will work hard to provide you with a vigorous defense. We represent individuals in state and federal court who have been charged with offenses ranging from simple drug possession to drug trafficking. This includes:

  • Marijuana possession or distribution,
  • Methamphetamine (meth) possession, distribution, trafficking, or manufacture
  • Heroin possession or distribution
  • Cocaine possession or distribution
  • Ecstasy possession or distribution
  • Prescription drug crimes
  • Doctor shopping

Property Crimes

Property crimes such as shoplifting, burglary, robbery, and other forms of theft can be some of the more challenging to investigate and prosecute. As a former prosecutor now dedicated to defending Utahns against criminal charges, I know firsthand that police do not always follow proper procedures in gathering evidence.

If you are under investigation for or have been charged with a property crime, you will need a strong, strategic criminal defense. I will take a thorough approach to your case and will work hard to protect your rights. This includes:

  • A careful review of all police reports, body cam, and dash cam, in an effort to find procedural illegalities or missteps;
  • An examination of all forms of evidence against you, including fingerprints, DNA, video surveillance footage, and witness statements — and calling on expert witnesses if necessary to show unreliable evidence;
  • Adept cross-examination of police and eye witnesses in order to expose potential issues in the investigation, such as mistaken identity.

Assault Charges & Domestic Disputes

While any criminal charge requires a vigorous and detailed defense, the government prosecutes domestic violence offenses and violent crimes aggressively. As a former Deputy District Attorney in charge of prosecuting felony and misdemeanor violent crimes, I bring my hands-on experience of prosecution strategies, and my thorough understanding of state and federal laws, to your defense. I help clients facing a wide range of domestic violence charges or ‘person’ crimes, including:

  • Assault, from disorderly conduct to aggravated assault, including domestic violence
  • Sexual assault, rape, and other sex crimes
  • Protective order or jail release agreement violations
  • Stalking, threats of violence, electronic communications harassment
  • Manslaughter and vehicular manslaughter
  • Homicide/murder

I will employ a careful, thorough investigation of the issues involved in your case, including:

  • Illegal search and seizure issues
  • The use and application of DNA evidence
  • Analysis of witness accounts, police reports and other evidence
  • Cross-examination of witnesses and any expert witnesses who may be called at trial

I also have expertise managing the press and protecting your and your family’s privacy during this difficult time. I maintain strict confidentiality with my clients throughout the entire criminal process.

Financial Crimes

All kinds of people — executives, assistants, accountants, licensed professionals, and others — come under investigation for white collar crimes they may have never even heard of. We know your case may involve decisions you made because of personal hardship, pressure from superiors, or a vast range of other factors.

For many state and federal prosecutors, indicting and convicting white collar criminals is a priority. Conviction on felony charges such as embezzlement, fraud, or money laundering could mean a lengthy prison term and irreparable damage to your career. If you have been arrested or contacted as part of a government investigation — even as a witness — contact us for savvy legal guidance that could make the difference for your future.

Weapons Offenses

Weapons Offenses

In Utah, an individual can be charged with a gun-related offense if a firearm was used in the commission of a crime or if the individual was not legally allowed to possess a firearm at the time. Violating Utah laws pertaining to weapons and firearms can result in serious consequences. Some individuals who are prosecuted may not even know they were committing an illegal offense, including those who carried a firearm or dangerous weapon while under the influence of alcohol, even with a permit.

Common gun and weapon offenses include:

  • Possession of a firearm as a restricted person
  • Possession of a dangerous weapon as a restricted person
  • Carrying a loaded firearm in a vehicle or street
  • Felony discharge of a firearm
  • Alteration of a weapon
  • Providing weapons to minors

Penalties for firearms and weapons crimes can include fines, community service, and jail or prison time.

At Pitcher Law, we can help you avoid the serious consequences of your gun or weapons charge. We have experience with all misdemeanor and felony weapons offenses and are prepared to help you build a strong defense.

Sex Crimes

Sex offenses are some of the most aggressively prosecuted crimes in the state of Utah. Many of these charges carry a minimum mandatory prison sentence if convicted. As a former felony prosecutor, I bring over a decade of experience to the table — including firsthand insight into how Utah law enforcement investigates allegations of sex crimes and how Utah prosecutors handle these cases. I will aggressively investigate the issues and allegations in your case, including a thorough investigation into the credibility and motivations of those making allegations against you.

With your freedom and reputation on the line, it is essential to work with a lawyer who understands how to prepare the strongest possible defense to these allegations. If you or someone you know has been accused of rape or sexual misconduct, contact us for a personal, confidential consultation on your defense.

Expungements

Expungements

For many individuals, the consequences of a criminal conviction are far-reaching. Nearly all employers ask if you have a prior conviction, and a criminal record can prevent you from pursuing educational opportunities or obtaining a particular certification of license. A criminal conviction can also affect divorce proceedings, child custody arrangements, and even personal relationships.

In Utah, many people are eligible to expunge prior convictions or seal their records. Some qualify for automatic expungement under Utah’s 2019 Clean Slate law. Others will need to petition the court to get their record cleared. If you have questions about the expungement process and whether you are eligible for expungement, we can help. Call us for a free consultation of your case and the potential wait times and court fees associated with your expungement request.
